Can Maharashtra FDA Shut Down a Restaurant Immediately? What the Law Says About Tukaram Mundhe’s Crackdown

Maharashtra’s intensified food safety inspections have raised an important legal question: can the state’s Food and Drug Administration (FDA) suspend a restaurant’s licence and force it to stop operating immediately, or must authorities first issue a warning and allow the owner to correct violations?

The issue has gained prominence under FDA Commissioner Tukaram Mundhe, whose enforcement drive has targeted restaurants, hotels, dairies, canteens and other food businesses across the state. While the administration has defended strict action as necessary to protect public health, court proceedings have highlighted the importance of following legal procedures and ensuring that penalties match the seriousness of the violations.

The central issue is not whether food safety authorities can take decisive action. It is whether the circumstances justify immediate intervention without first giving the business an opportunity to respond.

What Does the Food Safety Law Permit?

The Food Safety and Standards Act, 2006, provides the legal framework for regulating food businesses in India. It establishes requirements for food hygiene, licensing, storage, preparation and the handling of products intended for consumption.

Section 32 of the Act deals with improvement notices. When a food business operator fails to comply with the relevant requirements, the designated officer can issue a notice identifying the shortcomings and specifying the corrective measures required.

The business is generally expected to comply within the period stated in the notice. If it fails to do so, further regulatory action may follow, including suspension or cancellation of its licence, subject to the applicable legal provisions.

However, the law also recognises circumstances in which a faster response may be necessary. Where continuing operations create a genuine risk to public health, authorities can exercise their statutory powers to suspend a licence without waiting for the ordinary improvement process to run its course.

The distinction is crucial: immediate suspension is a legal option in appropriate circumstances, but it is not necessarily the automatic response to every inspection failure.

Why Courts Have Questioned Some Closure Orders

Several food businesses affected by the enforcement campaign have challenged regulatory decisions before the Bombay High Court and its benches outside Mumbai.

In a number of cases, courts have questioned whether the violations identified during inspections were sufficiently serious to justify immediate suspension. Some orders were stayed or reversed, while other proceedings focused on whether the authorities had followed the required procedure.

The legal concern is proportionality. A situation involving an immediate threat to consumers may warrant urgent intervention, whereas a less serious, correctable deficiency may call for an improvement notice and a reasonable opportunity to comply.

Courts have also emphasised that administrative action must be supported by the circumstances of each case. A broad campaign to improve hygiene does not remove the obligation to assess individual establishments fairly.

These proceedings do not mean that restaurants are exempt from food safety requirements. Rather, they establish that enforcement decisions can be examined against the powers granted by law and the evidence recorded during inspections.

Why the FDA Is Intensifying Inspections

The enforcement campaign has focused on issues such as poor kitchen hygiene, pest infestations, unsafe food storage, inadequate sanitation and failures to meet licensing requirements.

Such violations can expose consumers to preventable health risks, particularly when contaminated ingredients or improperly handled food are served to large numbers of people. Regular inspections are therefore an important part of the regulatory system.

The challenge for authorities is to distinguish between deficiencies that can be corrected within a specified period and conditions that make continued operations unsafe. Documenting inspection findings and explaining the reasons for a particular penalty are essential to that distinction.

What Restaurant Owners and Consumers Should Know

Restaurant operators must comply with applicable food safety standards and respond to valid regulatory notices. Businesses facing immediate suspension can examine the legal basis for the order and pursue available remedies where they believe the decision is unjustified.

Consumers, meanwhile, have a legitimate interest in both effective inspections and reliable enforcement. Unsafe establishments should not be allowed to expose the public to avoidable risks, but regulatory decisions must also remain accountable.

Ultimately, Maharashtra’s food safety drive illustrates the balance between protecting public health and respecting due process. The law permits urgent action when circumstances demand it, while requiring enforcement authorities to justify their decisions under the applicable legal framework.
