CJI Surya Kant Steps In After Delhi Police Detain Lawyers Near Supreme Court

Chief Justice of India Surya Kant intervened on October 10 after the Supreme Court Bar Association raised concerns over the detention of several advocates in New Delhi during heightened security arrangements ahead of a planned protest.

Around 50 to 60 lawyers, including senior advocates and women legal professionals, were reportedly detained near the Supreme Court premises. They were released later after the Chief Justice contacted the authorities, according to reports.

The incident triggered concern within the legal community, with the Supreme Court Bar Association (SCBA) seeking clarification about the lawyers’ whereabouts, their safety and the circumstances surrounding the police action.

Bar Association Seeks Urgent Intervention

SCBA president Pradeep Rai publicly raised the issue on Saturday, expressing concern over reports that lawyers had been detained, including some from their chambers. He called for their immediate release and brought the matter to the Chief Justice’s attention.

The association subsequently passed a resolution condemning the reported use of excessive force against advocates who, it said, had been peacefully demonstrating in the Supreme Court area.

In its communication to the CJI, the SCBA requested that officials establish the whereabouts of all detained lawyers, ensure their safety and provide access to legal assistance where required. It also called for the circumstances of the detentions to be examined and appropriate action taken in accordance with the law.

The association’s response placed the treatment of legal professionals at the centre of a wider debate over police powers and the right to peaceful protest.

Lawyers Released After CJI Contacts Authorities

Following the SCBA’s appeal, the Chief Justice contacted the relevant authorities. The detained advocates were subsequently released, according to reports.

The intervention was also acknowledged by the Supreme Court Advocates-on-Record Association, which was among those that brought the matter to the CJI’s attention.

The release addressed the immediate concern over the lawyers’ detention, although questions remained about the circumstances in which they had been taken into custody and the allegations of excessive force.

The incident also prompted calls from legal bodies for a closer examination of the police response and for safeguards to be respected when lawyers participate in demonstrations.

Detentions Amid Security Measures for Delhi Protest

The episode took place as Delhi authorities tightened security ahead of a planned demonstration by the Cockroach Janta Party (CJP) at Jantar Mantar.

The protest was linked to demands for the resignation of Chief Election Commissioner Gyanesh Kumar and objections to the Special Intensive Revision (SIR) of electoral rolls. The party and other critics have raised concerns about the voter-list revision process, while the political dispute has contributed to tensions surrounding the planned gathering.

Police had imposed restrictions on the proposed demonstration, citing law-and-order concerns. Security deployments and preventive detentions were reported at multiple locations across the capital as authorities sought to manage the situation.

The broader operation affected activists and other people attempting to participate in or reach protest sites. The detention of lawyers near the Supreme Court added a further dimension to the controversy because of the concerns raised by the legal fraternity.

Questions Over Police Conduct and Civil Liberties

The incident has renewed attention on the balance between maintaining public order and protecting the right to peaceful assembly. While authorities can impose lawful restrictions in specific circumstances, the grounds for detaining individuals and the manner in which those detentions are carried out remain important questions.

The SCBA has called for the reported use of force to be examined, rather than treating the lawyers’ eventual release as the end of the matter. Its intervention also highlighted the role of professional legal associations in responding when members of the bar face alleged violations of their rights.

For now, the lawyers’ release has eased the immediate situation. However, the demand for scrutiny of the police action remains, as legal professionals seek clarity over why the advocates were detained and whether the conduct of officials complied with the law.
